Course description

 

1.Overview (teaching ideas and aims of this course)

This course will mainly deal with the fundamental aspects of intellectual property (IP): patent, copyright and related rights and trademark. It will also cover contemporary issues impacting the IP field such as: geographical indications, enforcement of IP rights and emerging issues in IP. The course will provide students with essential knowledge about the theoretical rationales and policy arguments for intellectual property rights. It will explain the basic principles of Intellectual Property Law and the nature and scope of these rights, the procedures, both national and supranational, for the granting and recognition of the rights, and mechanisms for enforcement as well as defences against enforcement. This course will enable students to develop a fully rounded understanding of all of the major intellectual property rights, their role in society and the impact of intellectual property on national and global economics and development.

 

2.Contents

This course will cover the following subjects:

Fundamentals of the intellectual property system.
Patent law: Rationale, requirements for patentability, ownership and licensing, infringement, remedies, defences. Practice and management of patents.
Copyright law: Rationale and subsistence, subject matter (literary, artistic, musical and audivisual works, etc.), ownership, licensing, moral rights, economic rights, infringement, permitted acts.
Trade mark law: Registration, Absolute grounds for refusal of registration, infringement and relative grounds for refusal of registration, defences, invalidity, revocation, use. Practice and management of trade marks, The law of passing off and the legal protection for unregistered trade marks.
Intellectual property licensing (negotiation, international perspectives – jurisdiction clauses, arbitration requirements) and elements of technology transfer.
Contemporary issues in the IP field: geographical indications, enforcement of IP rights and emerging issues in IP, such as intellectual property issues on the internet.
 
3.Teaching method 
Besides taught by the professor, this course will exploit various teaching methods, including classroom discussion, classic literatures reading and comprehension, case studies and Socratic method for inspiration of ideas.
 
4.Course evaluation
final exam: 60%; 
classroom attendance, classroom discussion ,homework and assignment: 40%.

近两年来授课、教学研究情况

为法学专业本科生开设《知识产权法》(与徐棣枫、解亘合上),面向全校各专业学生开设本科生新生研讨课《知识产权法》(与徐棣枫合上)。

英语教学情况:参与南京大学中德法学研究所“中国法与比较法”LLM外国留学生教学,2014年秋季学期与方小敏教授为来自德国、美国的6位研究生合上《中国经济法》,英语讲授其中的“知识产权法”部分(共8课时)。

国外学习经历:2003-2005年,韩国国际法律经营大学攻读国际法专业硕士学位(英语课程),期间曾赴WTOWIPOIL0EUICJICC等国际组织或司法机构实地考察和学习。
